APPLIANCE WARRANTY CERTIFICATE — CONSUMER PURCHASES (SOUTH AFRICA)
This certificate sets out the Minus40 manufacturer warranty for appliances bought for personal, household, or domestic use. It applies in addition to, and does not limit, your rights under the Consumer Protection Act, 2008 (the CPA).
DEFINITIONS
- “You” or “the Customer” means the original purchaser of the appliance for personal, household, or domestic use.
- “the Product” means the Minus40 appliance covered by this certificate.
- “Minus40” and “M40 Refrigeration” mean the separate companies that sell Minus40-branded appliances. Whichever one sold you the Product, as shown on your invoice, is referred to in this certificate as “the Supplier”.
- “the Services Team” means M40 Refrigeration’s service department, which handles all warranty claims and repairs for Products sold by either company.
- “Services” means repair, maintenance, installation, or other work that the Supplier or M40 Refrigeration agrees to carry out on the Product.
- “the Site” means the location where the Product is installed or used, not including the premises of Minus40 or M40 Refrigeration.
- “the Warranty Period” means the period set out under WARRANTY PERIOD below.
YOUR CPA RIGHTS
Under section 56 of the CPA, this appliance carries a six-month implied warranty of quality from the date of delivery. If it is found to be defective, unsafe, or unfit for its intended purpose during this period, you may return it for repair, replacement, or refund, at no charge. This right applies regardless of any other term in this certificate.
WARRANTY PERIOD
- 12 months from date of purchase, parts and labour, for appliances used within South Africa.
- 12 months, parts only, for appliances exported outside South Africa. Labour and travel costs outside South Africa are for the purchaser’s account.
INSTRUCTION MANUAL
Every Minus40 appliance is supplied with an instruction manual covering installation, use, and maintenance. This warranty is conditional on the appliance being installed, operated, and maintained in accordance with that manual. Where a fault is caused or contributed to by failure to follow the manual, this warranty does not apply.
RAISING A CLAIM
All warranty claims must be logged with the Services Team and given a ticket number. Without a ticket number, a claim cannot be processed — warranty issues raised directly with sales representatives, drivers, or other staff cannot be tracked or actioned.
Raise a ticket by:
- Submitting the form at m40refrigeration.com
- Emailing service@m40refrigeration.com
- Calling +27 21 386 2290 or WhatsApp +27 84 602 9586
Include your proof of purchase, the appliance serial number, a description of the fault, and photo or video evidence of the fault itself. Claims submitted without visual evidence of the fault cannot be assessed or progressed.
WHAT WE WILL DO
Once a ticket number has been issued, if a part is found by the Services Team to be defective in material or workmanship under normal use, the Services Team will repair or replace it, at its discretion, at no cost to the original purchaser, using its own technicians or an appointed refrigeration agent.
Before signing for delivery, the Purchaser must unpack and inspect the appliance, accessories, and panels. Any damage found must be noted on the waybill before the transporter leaves, photographed, and reported via a logged ticket within 48 hours. Signing the waybill without inspecting voids the transport damage claim. Where these steps are followed, the Services Team will repair or replace the appliance at its own cost.
If the Purchaser arranges their own collection or transport, the Services Team cannot repair or replace damage occurring during or after that transport. Please inspect the appliance before it leaves the Supplier’s premises.
WHAT IS NOT COVERED
This warranty does not cover transport damage where the waybill was signed without inspecting the appliance and packaging on delivery, as set out above.
This warranty does not cover faults caused by:
- Any repair, service, or modification carried out by anyone other than Minus40, M40 Refrigeration, or a third party specifically authorised in writing by M40 Refrigeration for that specific job prior to the work being carried out
- Incorrect voltage, faulty supply wiring, or failure to use the voltage protector provided
- Power surges or multi-plug extensions
- Installation, operation, or maintenance that does not follow the instruction manual, or general misuse or abuse
- Failure to clean the condenser as instructed
- Fire, flood, civil disturbance, or other events beyond the Supplier’s control
It also does not cover normal wear and tear, cosmetic damage to interior or exterior finishes, breakage of glass or plastic components, broken lights, or damage to door or lid surfaces, unless present at the time of delivery.
LIABILITY
Where permitted by law, the Supplier’s liability under this certificate is limited to the repair, replacement, or refund described above. Nothing in this certificate excludes or limits any right or remedy available to the Purchaser under the CPA, including claims for harm caused by unsafe or defective goods under section 61.
REPAIR COSTS AND THE WARRANTY PERIOD
A repair, replacement, or other remedial work carried out under this certificate does not extend or restart the Warranty Period — it continues to run from your original date of purchase.
For the first six months from delivery, where the Product is repaired or replaced under your CPA rights (see above), the Supplier will not charge you for transport, removal, or reinstallation connected with that repair.
After this initial six-month period, and for any repair carried out under the Minus40 manufacturer warranty rather than your CPA rights, you are responsible for the costs of getting the Product to and from the Supplier or M40 Refrigeration for repair, including removal and reinstallation, and for any costs of accessing the Product at the Site to carry out the Services.
GENERAL
- This warranty is issued to the original purchaser and is linked to the appliance’s serial number. Removal or alteration of the serial number renders this warranty void.
- Costs of transporting the appliance for repair, beyond what is described under RAISING A CLAIM and REPAIR COSTS AND THE WARRANTY PERIOD, are for the purchaser’s account.
If any term of this certificate conflicts with the Consumer Protection Act, the Act prevails.
